The Problem: No AI-Specific Whistleblower Protection
As of February 2026, no country has enacted legislation specifically designed to protect individuals who report AI safety concerns. This is a remarkable gap. The technology that its own creators describe as potentially existential — a technology being deployed in healthcare, finance, criminal justice, military operations, and critical infrastructure — has no dedicated framework for protecting the people best positioned to warn us when something goes wrong.
The gap matters because AI safety concerns differ from traditional whistleblower scenarios in several critical ways:
The harm may be prospective, not retrospective. Traditional whistleblower protection typically covers reporting of violations that have already occurred — fraud that has been committed, pollution that has been discharged. AI safety concerns often involve risks that have not yet materialized but could if a system is deployed without adequate testing. Existing laws handle this poorly.
The “violation” may not be illegal. Deploying an unsafe AI system may not violate any existing law, particularly in jurisdictions without comprehensive AI regulation. A safety researcher who sees that a model can be used to generate bioweapons instructions is not reporting a legal violation — they are reporting a risk. Most whistleblower laws require a legal or regulatory violation as a predicate.
NDAs and non-disparagement clauses are ubiquitous. AI companies routinely require employees to sign broad non-disclosure agreements and non-disparagement clauses that can be wielded against anyone who speaks publicly about safety concerns. These contractual constraints exist in addition to whatever legal protections might apply.
The stakes are unique. If a financial whistleblower is wrong, a company is unfairly investigated. If an AI safety whistleblower is silenced and they were right, the consequences could be catastrophic. The asymmetry of consequences demands asymmetric protection.

The US has the most developed general whistleblower protection framework in the world, but none of it was designed for AI.

The critical gap: The vast majority of AI safety concerns arise in private-sector companies that are not publicly traded, do not hold government contracts, and are not in regulated financial services. For employees of these companies — which include some of the most important AI labs in the world — no federal whistleblower statute provides clear protection.
Proposed legislation: As of February 2026, at least three bills have been introduced in Congress that would create AI-specific whistleblower protections, including requirements that AI companies cannot use NDAs to suppress safety disclosures. California SB 1047 (vetoed): Had SB 1047 been signed, it would have included explicit whistleblower protections for AI safety researchers, prohibiting retaliation against employees who report safety concerns to regulators. Its veto left a significant gap.

The EU advantage: The combination of the Whistleblower Directive and the EU AI Act creates the strongest framework available anywhere. Article 87 of the AI Act explicitly requires that member states ensure persons reporting infringements are protected in accordance with the Whistleblower Directive. An employee who reports that their company is deploying a high-risk AI system without the required conformity assessment is reporting a breach of EU law and should be protected.
The EU limitation: The Directive requires that the report concern a breach of EU law in specified areas. Pure AI safety concerns — “this model could be dangerous even though no law prohibits it” — may not be covered. Additionally, the Directive protects reporting through designated channels, and public disclosure is protected only as a last resort.

Timnit Gebru
Organization: Google (AI Ethics team) When: December 2020 What happened: Gebru co-authored a paper highlighting risks of large language models, including environmental costs, bias in training data, and the potential for these systems to reinforce existing power structures. Google asked her to retract the paper or remove her name. She refused and was terminated.
Outcome: Gebru’s firing became a landmark moment in AI ethics. It demonstrated that even senior researchers at major AI labs face retaliation for raising safety and ethics concerns. She subsequently founded the DAIR (Distributed AI Research) Institute. Her co-author, Margaret Mitchell, was also fired from Google shortly after.

The OpenAI Safety Exodus (2024)
This was the event that brought AI whistleblowing into mainstream awareness. Between April and July 2024, multiple senior members of OpenAI’s safety teams departed the company, citing fundamental concerns about the organization’s priorities.
Jan Leike — Co-lead of OpenAI’s Superalignment team. Resigned in May 2024. Publicly stated that safety culture and processes had taken a back seat to product launches. Described a pattern where the Superalignment team struggled to obtain computational resources and institutional support for safety research. His departure was a direct indictment of OpenAI’s internal priorities.
Daniel Kokotajlo — OpenAI governance researcher. Professional Risks
- Termination: AI companies have fired employees for raising safety concerns publicly. The cases above demonstrate this is not theoretical.
- Blacklisting: The AI industry is small and interconnected. Speaking out against a major lab can make it difficult to find employment at others. Informal reputation damage is difficult to prove and impossible to prevent.
- Equity forfeiture: Many AI companies structure compensation heavily toward equity that vests over years. Departure — voluntary or forced — can mean forfeiting millions of dollars. Non-disparagement clauses attached to equity agreements create explicit financial penalties for speaking out.
- Non-compete enforcement: Some jurisdictions allow enforcement of non-compete agreements that can prevent you from working in AI after departure (though California’s ban on non-competes provides some protection).
- Reputational framing: Companies may characterize whistleblowers as disgruntled, technically unsophisticated, or personally unstable. This narrative is difficult to counter.

- NDA enforcement: Broad non-disclosure agreements may be used to seek damages or injunctive relief against employees who share information, even for safety purposes.

- Write a contemporaneous memo describing what you observed, when, who was involved, and the safety implications. Date it. Store it securely.

- Do not alter or fabricate any documents. Your credibility is your most valuable asset.
- Be specific. Actionable: “The safety evaluation for Model X was completed in 3 days instead of the planned 30, and 7 of 12 safety tests were skipped before deployment.” Not actionable: “I feel like safety isn’t being prioritized.”

What Needs to Change
The absence of AI-specific whistleblower protection is not an oversight. It is the predictable result of an industry that has lobbied against regulation while asking the public to trust its voluntary safety commitments. The people best positioned to verify whether those commitments are being honored — the employees who work on safety — are the people with the least protection if they report that they are not.
What is needed:
1. Federal and national legislation specifically protecting AI safety disclosures. This must cover private-sector employees, not just government workers. It must protect disclosures about prospective risks, not only violations that have already occurred. It must apply regardless of whether the AI system at issue violates any existing law.
2. Prohibition on using NDAs and non-disparagement clauses to suppress safety disclosures. These contractual instruments should be unenforceable when applied to good-faith safety concerns, regardless of what the employee signed. The Right to Warn letter asked for this. Congress should mandate it.
3. Equity protection. Vested equity must not be contingent on non-disparagement or non-disclosure compliance related to safety concerns. Forfeiture of earned compensation as punishment for safety disclosures is economic coercion.
4. Anonymous reporting channels with regulatory backing. Employees should be able to report concerns to an AI Safety Institute or equivalent body without revealing their identity to their employer. The reporting body must have the technical expertise to evaluate the concern and the authority to act on it.
5. Anti-retaliation provisions with teeth. Including reinstatement rights, treble damages, compensation for lost equity, and personal liability for executives who authorize or direct retaliation against whistleblowers.
6. International coordination. AI companies operate globally. A whistleblower who raises concerns in one jurisdiction should not face retaliation through operations in another. This requires minimum international standards for AI whistleblower protection.
Until these changes are made, the AI industry’s claim that it takes safety seriously will remain unverifiable by design. You cannot simultaneously claim to prioritize safety and structure your employment contracts to punish the people who report that you are not doing so.
